1. Agreement to Terms
By accessing or using Pulse Room ("the Service"), operated by Generation Ad LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
The Service is a hospitality intelligence platform that aggregates publicly available review data, reservation statistics, and competitor benchmarks for restaurant operators.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements. The Service is intended for business use by hospitality professionals.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
Each account is for a single organization. Sharing credentials across organizations is prohibited.
4. Subscription and Billing
The Service is offered on a subscription basis with monthly or annual billing cycles. Prices are listed in US Dollars and are subject to change with 30 days' notice. All fees are non-refundable except as described in our Refund Policy.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting us.
5. Free Trial
If offered, free trials provide temporary access to the Service at no charge. We may require payment information to start a trial. If you do not cancel before the trial ends, your subscription will begin and you will be charged.
6. Acceptable Use
You agree not to misuse the Service. This includes but is not limited to: reverse-engineering, scraping, redistributing data, interfering with infrastructure, impersonating others, or using the Service for unlawful purposes. See our Acceptable Use Policy for details.
7. Intellectual Property
All content, features, and functionality of the Service are owned by Generation Ad LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Data and insights generated by the Service for your account may be used by you for your internal business purposes only.
8. Data and Privacy
We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing. The Service aggregates publicly available information from third-party platforms. We do not guarantee the accuracy, completeness, or timeliness of third-party data.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERATION AD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your access at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.
